  79. ~~~~~~~~~~~
  80. 'Software' or 'Program' means the ChaoSoft software product
  81. File Manager StepUp (FM StepUp), including both the software and the
  82. associated documentation and other materials;
  83.  
  84. 'Unregistered Copy' means a copy of the Program you obtained from
  85. us or other source for evaluation purposes and which is described
  86. as "Unregistered copy" in the 'About' screen. An Unregistered Copy
  87. may be converted to registered one by supplying a name of a
  88. registered user or institution and a correct Registration Code,
  89. which may be obtained from ChaoSoft or its authorized dealer(s).
  90.  
  91. 'Registered Copy' means a copy of the Program registered with
  92. ChaoSoft or with its authorized dealer, and which is described as
  93. "Registered to: <user name>" in the 'About' screen. A Registered
  94. Copy may be unregistered by copying it to another disk or
  95. computer, or by removing the registration information from an
  96. initialization file.

  98. 'Registration Package' means all the materials you are obtaining
  99. from us after sending us your registration fee. In particular,
  100. Registration Package contains your personal Registration Code,
  101. allowing you to remove the registration reminder message and put
  102. your name in the 'About' screen.

  104. 'we' or 'us' means ChaoSoft, a company produced this software

  108. 'you' means the end user or distributor of the Software.

  110. Legal Agreement.

  130. this license agreement, is granted to you. You may not copy any
  131. written or printed materials from your Registration Package and
  132. you may not rent or lease a Registered Copy of the Software.

  134. TRIAL USE LICENSE

  136. ChaoSoft grants to you a limited license to use an Unregistered
  137. Copy of this software for evaluation purposes for a period not to
  138. exceed 14 days.

  140. This period may be not a contiguous sequence of days. However, you
  141. should count a day as an evaluation day if you used the Program
  142. during that day at least once. The purpose of this evaluation
  143. period is to allow you to determine whether the program meets your
  144. needs before purchasing it.

  146. Once the evaluation period has ended, you MUST either purchase a
  147. license for continued use of the program, or stop using it.  Use of
  148. an Unregistered Copy beyond the end of the evaluation period without

  152. use your Unregistered Copy beyond the end of the evaluation period

  155. Registering the Program.

  162. your Unregistered Copy of the Software into Registered one.

  164. You agree to keep the Registration Code for your own use only and
  165. not to share it with anybody else.

  167. REGISTERED COPY USE LICENSE

  169. ChaoSoft grants to you the right to use a Registered Copy of the
  170. software, if you registered (purchased a license for continued use)
  171. with us or our authorized dealer and obtained your Registration
  172. Code.

  174. You may install a Registered copy of the software on more than one
  175. computer (for example, desktop system and portable notebook),
  176. provided that you are the only user of those computers and there
  177. is no possibility to use the Registered Copy by anybody else.

  179. You may not network a Registered Copy or otherwise use it on more
  180. than one computer or computer terminal at the same time unless you
  181. have purchased a site license.

  183. If the Registered Copy you are using is registered to anybody
  184. else, you MUST either unregister it by removing the registration
  185. information, or stop using it. Use of a Registered Copy,
  186. registered to anybody else except you (or, for site license
  187. arrangements, to your organization), is in violation of federal

  190. Multi-User and Network Use.

  192. If you registered the Software for use by multiple users,  you
  193. agree not to use the Program on more computers than the number
  194. specified in your site license. You may install the Program on
  195. computers attached to a network, or remove it from one computer
  196. and install it on a different one, provided there is NO
  197. POSSIBILITY that your copy will be installed or used on more
  198. computers than it is licensed for.  If you have a network, you
  199. don't need to include every computer attached to the network in
  200. your license, but you must include every computer on which the
  201. Program is installed or used, regardless of whether the user of
  202. the computer happens to know that the Program is in use on their
  203. system.  If you have single computers which allow multiple users
  204. to use the Program simultaneously, you must count each keyboard or
  205. terminal separately when determining how many computers are using
  206. the Program.

  208. LIMITED DISTRIBUTION LICENSE

  262. LIMITED WARRANTY

  264. The following limited warranty applies to Registered Copies of the
  265. Program. This warranty does NOT apply to Unregistered Copies of
  266. the Program.

  268. Satisfaction Guarantee.  If you are dissatisfied with any product
  269. you buy from us under this Agreement for any reason, you may
  270. return it at any time up to 30 days after purchase and we will
  271. give you a refund. Refunds will be based on the price you paid,
  272. with shipping costs excluded.  You must contact us before
  273. returning any product for a refund. This satisfaction guarantee
  274. does not apply to multi-system licenses for more than 10
  275. computers, or to purchases of more than 10 individual copies at a
  276. time.

  278. Physical Defects.  We pledge that the disks, if any, and any
  279. printed material we send you will arrive free of physical defects
  280. which interfere with normal use. If you find such a defect and
  281. report it to us within 30 days after you get your Registration
  282. Package, we agree to replace the defective item(s) at no charge to
  283. you as long as the defect was not caused by misuse or abuse.

  285. Bugs and Program Errors.  We don't promise that the Software will
  286. be free of bugs or program errors, and you agree that bugs or
  287. program errors will not be considered as "physical defects" in the
  288. program. We agree that if you report a program error or bug to us,
  289. we will use our best efforts to correct it.
